These Terms of Service ("Terms") govern your use of macfitt.com and coaching services offered by MacFitt, operated by Jack McNamara ("we," "us," or "our"). By using our website, booking a consultation, or purchasing coaching, you agree to these Terms.
Services
MacFitt provides personal training, strength coaching, nutrition guidance, and related fitness coaching services. In-person sessions are offered at Tiger ATX Training, 7401 Old Bee Caves Rd, Austin, TX 78735. Remote coaching may be delivered through platforms such as Built For Life, as described on our online training page. Service scope, pricing, and package details are confirmed in writing before coaching begins.
Eligibility and Health Disclosure
Our services are intended for adults who can participate in exercise with appropriate guidance. You are responsible for providing accurate health and fitness information and for obtaining clearance from a licensed physician before starting or changing an exercise program if you have medical conditions, injuries, pregnancy, or other health concerns.
Not Medical Advice
Coaching, nutrition guidance, and website content are for general fitness and educational purposes only. They are not medical advice, diagnosis, or treatment. Always consult qualified healthcare professionals for medical decisions.
Consultations and Coaching Relationship
A free consultation helps us determine whether we are a good fit. Coaching begins only after mutual agreement on services, schedule, and payment terms. We reserve the right to decline or discontinue services when safety, conduct, or fit concerns arise.
Payments, Packages, and Cancellations
Fees, billing schedules, expiration dates, and cancellation or rescheduling policies are provided before you purchase a package or ongoing coaching plan. Unless otherwise stated in your agreement:
- Payments are due according to the package or billing terms you accept.
- Missed sessions may be subject to the cancellation policy shared at signup.
- Refunds, credits, and package extensions are handled according to your written agreement and applicable law.
- Prices and offerings may change for future purchases but will not retroactively alter an active agreement without your consent.
Client Responsibilities
You agree to:
- Follow safe training practices and communicate pain, injury, or limitations promptly.
- Arrive on time and prepared for scheduled sessions, or provide notice required by your cancellation policy.
- Use programming and materials for personal use only unless we give written permission otherwise.
- Treat staff, facility partners, and other clients with respect.
Assumption of Risk
Physical exercise involves inherent risks, including injury. You voluntarily assume these risks and agree that ${businessName} and ${coachName} are not liable for injuries or losses resulting from your participation except where liability cannot be limited under applicable law.
Limitation of Liability
To the fullest extent permitted by law, MacFitt and Jack McNamara are not liable for indirect, incidental, special, consequential, or punitive damages arising from use of our website or services. Our total liability for any claim related to services is limited to the amount you paid us for those services in the three months before the claim arose, unless a greater minimum is required by law.
Intellectual Property
Website content, branding, training materials, and programming created by MacFitt are protected by intellectual property laws. You may not copy, distribute, or resell our materials without written permission.
Website Use
You may use our website for lawful personal purposes. You may not attempt to disrupt the site, scrape content for commercial use, upload malware, or misuse contact forms or other features.
Third-Party Services
We may link to or use third-party tools such as mapping services, payment processors, or coaching apps. Your use of those services is subject to their own terms and policies.
Termination
Either party may end the coaching relationship according to the applicable package or service agreement. We may suspend website access or services for violations of these Terms or for conduct that creates safety or legal risk.
Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Disputes will be handled in courts located in Travis County, Texas, unless otherwise required by law.
Changes to These Terms
We may update these Terms from time to time. The effective date at the top of this page shows when they were last revised. Material changes will be posted on this page. Continued use of our website or services after updates means you accept the revised Terms.
